Please read these Terms carefully before using this Website. By accessing, browsing, or using this Website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not accept these Terms of Use, do not use the Website.
By using the Service, you consent to the submission of your personally identifiable information, including sensitive personal data such as financial information if you opt for our paid membership, identity proofs if submitted, and other relevant details. This information will be collected, processed, displayed, and used to provide the Service and to enable contact with other Members. If you have any objections to the collection or processing of your personal data, we advise you not to register on our Site.
If you wish to withdraw this consent or have any objections to the continued collection or storage of your personal details, you must discontinue using our Service and delete your account. To do so, send an email from your registered email ID to support@aabadrishtey.com, as we cannot provide any Service without your personally identifiable information.
a. Legal Competence and Age Requirements
To register as a Member of Aabad Rishtey or use this Site, you must be legally competent and of legal marriageable age according to the laws of India (currently, 18 years or older for females and 21 years or older for males).
b. Purpose of the Site
The Aabad Rishtey site is intended solely to facilitate personal advertisements for lawful marriage alliances between persons who are legally competent to enter into matrimony under the laws applicable to them. Membership in the Service is void where prohibited by law.
c. Representations and Warranties
By using this Site, you represent and warrant that you have the right, consent, authority, and legal capacity to enter into this Agreement; to submit relevant information to us; and that you are not prohibited or prevented by any applicable law, order, decree, or injunction from any court, tribunal, or other competent authority from entering into matrimony.
2. Eligibility
d. Purpose and Conduct
You further confirm that you intend to seek a life partner and will not use this site for casual dating or any commercial purposes. You also agree to abide by all the terms and conditions of this Agreement and use the Service in compliance with all applicable laws. If at any time Aabad Rishtey believes (in its sole discretion) or has reason to believe that you are not eligible to become a member, have made any misrepresentation, or violated any provisions of the Terms of Use or applicable laws, Aabad Rishtey reserves the right to immediately terminate your membership and/or your right to use the Service without any refund of your unutilized subscription fee.
e. Matching System Acknowledgment
By using this Site, you acknowledge that the match emails or the match search results shown to you by the system are based on the partner preference details you submitted in your profile.
f. Information Sharing and Promotions
Aabad Rishtey reserves the right to share information with third parties regarding any promotions or offers exclusive to our members. However, we will obtain your prior consent before sharing any of your data.
3. Account Security
You are responsible for maintaining the confidentiality of the login credentials you designate during the registration process and are solely responsible for all activities that occur under your account. You agree to immediately notify us of any unauthorized access or use of your account or any other breach of security. Additionally, you must ensure that you log out of your account at the end of each session.
4. Term and Termination
a. This Agreement will remain effective, valid, and in force as long as you use our Site.
b. You may terminate your membership at any time, for any reason, by deleting your profile from the Site or by writing to Aabad Rishtey. If you terminate your membership, you will not be entitled to a refund of any unutilized subscription fees, if any, paid by you, except where otherwise guaranteed in writing.
c. Aabad Rishtey may terminate your access to the Site and/or your membership for any reason, including but not limited to breach of the terms of use, using the Service for commercial purposes, engaging in prohibited or inappropriate communication or activity. In such cases, notice will be sent to the email address provided by you during registration or any other email address you may later provide to Aabad Rishtey. If Aabad Rishtey terminates your membership due to a breach of this Agreement, you will not be entitled to any refund of any subscription fees paid by you.
d. Certain provisions of this Agreement, including Sections 4, 5, 6, 7, and Sections 9 to 16, shall remain effective even upon termination.
e. The term for paid membership will be in accordance with the type of membership undertaken.
f. In the event of business discontinuity, the Company shall refund 50% of the unused membership fees paid by you.
5. Non-Commercial Use by Members
The Site is for the personal use of individual members to advertise and promote their profiles for the purpose of generating interest from relevant matches. It cannot be used in connection with any commercial endeavors. This includes providing links to other websites, whether deemed competitive to Aabad Rishtey or otherwise. Organizations, companies, and/or businesses cannot become Members of Aabad Rishtey and should not use the Aabad Rishtey Service or Site for any purpose. Illegal and/or unauthorized uses of the Site, including unauthorized framing of or linking to the Site, will be investigated, and appropriate legal action will be taken, including, without limitation, civil, criminal, and injunctive redress.
6. Other Terms of Use for Members
a. Aabad Rishtey reserves the right, at its sole discretion, to review the activity and status of each account and block access to the member based on such review.
b. Aabad Rishtey reserves the right, at its sole discretion, to restrict or suspend your access to its website based on the review of your activity, status, or any other criteria that Aabad Rishtey deems fit and proper, with due intimation to you.
c. By registering with Aabad Rishtey, you hereby confirm that as of the date of this registration, you do not object to receiving emails, SMS/WhatsApp messages, and calls from Aabad Rishtey and its members as long as you are a registered member of Aabad Rishtey. This includes SMS permission for authenticating mobile verification and transactions via OTP sent by the Payment Gateway. This consent shall override any preferences set by you with or registration done with the Do Not Disturb (DND Register) or National Customer Preference Register (NCPR). This consent covers emails, messages, or calls related to but not limited to phone number verification, the provision of matchmaking advertising services, matchmaking inquiries, and promotions.
d. Multiple profiles of the same person are not allowed on our Site. Aabad Rishtey reserves the right to deactivate all such multiple profiles without any refund of subscription fees.
e. You confirm that the content and information, including the personal information provided by you, is correct and accurate. If you are creating a profile on behalf of a friend, sibling, or child, you hereby agree that you have the necessary permission or consent from the individual whose profile you are creating on Aabad Rishtey. Impersonation is a crime and is punishable under various laws.
f. You are strongly advised to submit a copy of your Driving License, Passport, or any other government-issued identity document and add a trust badge to your profile.
g. Except for promoting or advertising your profile for matchmaking purposes, you are not permitted to engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service.
h. Prohibited Conduct
You agree not to transmit any chain letters or junk email to other Aabad Rishtey Members. Although Aabad Rishtey cannot monitor the conduct of its Members off the Site, it is a violation of the Agreement to use any information obtained from other Members to harass, abuse, or harm another person, or to contact, advertise to, solicit, or sell to any Member without their prior explicit consent.
i. Protection Measures
Aabad Rishtey reserves the right to take appropriate steps to protect the platform and its Members from any abuse or misuse as it deems appropriate in its sole discretion.
j. No Harassment Policy
You agree not to use the Services and platforms to harass any Member, including through the ShaadiMeet, Near Me, or ShaadiLive features.
k. Respectful Interaction
You shall interact with other Members with due respect and ensure that you are decently dressed during ShaadiLive events or ShaadiMeet interactions.
l. Prohibition of Automated Processes
You are prohibited from using any automated processes, including IRC Bots, EXEs, CGI scripts, or any other programs/scripts to view content on or communicate with/contact/respond to/interact with Aabad Rishtey and/or its Members.
m. Communication Screening
Aabad Rishtey reserves the right to screen communications or advertisements that you may send to other Members and regulate the same by deleting unwarranted or obscene communications or advertisements at any time, at its sole discretion, without prior notice to any Member.
n. Privacy and Safety Precautions
Aabad Rishtey Members are expected to exercise simple precautions for their privacy and safety. A suggestive guideline of such precautions is listed under security tips in “Be Safe Online.” By becoming a Member, you hereby agree to read, abide by, and adhere to these Tips.
o. VIP Services Agreement
Aabad Rishtey Members who subscribe to the Aabad Rishtey Select Service or VIP Service hereby unconditionally and irrevocably confirm that you have read the terms and conditions and agree to abide by them.
7. Proprietary Rights in the Content on Aabad Rishtey
Aabad Rishtey owns and retains all proprietary rights in the Aabad Rishtey Site and the Aabad Rishtey Service. The Site contains copyrighted material, trademarks, and other proprietary information belonging to Aabad Rishtey and/or its licensors. Except for information that is in the public domain, such as member profiles, or for which permission has been obtained from the user, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Any such act or attempted act on your part shall constitute a violation of this Agreement, and your membership may be terminated immediately by Aabad Rishtey without any refund of your unused subscription fees. Aabad Rishtey reserves the right to take legal action (civil and/or criminal) wherever applicable for any violations.
8. Content Posted on the Site
a. You understand and agree that Aabad Rishtey may delete any listing, content, communication, photos, or profiles (collectively, “Content”) that, in the sole judgment of Aabad Rishtey, violate this Agreement or that might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of Aabad Rishtey and/or its Members.
b. With respect to the Content you submit or make available for inclusion on publicly accessible areas of the Site, including but not limited to your contact details, you hereby unconditionally and irrevocably grant Aabad Rishtey the consent and license to use, store, distribute, reproduce, prepare derivative works of, modify, adapt, publicly perform, and publicly display such Content on the Site and to the members of the Aabad Rishtey community site(s) from time to time.
c. By submitting your success story, you hereby expressly authorize Aabad Rishtey to use, publish, and display your photographs and testimony on the Site.
d. Responsibility for Content
You understand and agree that all information, data, text, photographs, graphics, communications, tags, or other content, whether publicly posted, privately transmitted, or otherwise made available to Aabad Rishtey, are the sole responsibility of the person from whom such Content originated. This means that you (and not Aabad Rishtey) are solely responsible for all Content that you upload, post, email, transmit, or otherwise make available via the Service. Aabad Rishtey does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity, or quality of such Content. We advise all users to independently verify the content or information posted by other members before acting upon it. Under no circumstances will Aabad Rishtey be liable for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted, or otherwise made available via the Service.
e. Content Authenticity
Aabad Rishtey reserves the right to check the authenticity of Content posted on the Site. In exercising this right, Aabad Rishtey may ask you to provide documentary or other forms of evidence supporting the Content you post on the Site. If you fail to produce such evidence to the satisfaction of Aabad Rishtey, we may, in our sole discretion, terminate your Membership without a refund.
f. Prohibited Content
The following is an indicative list of the kinds of Content that are illegal or prohibited on the Site. Aabad Rishtey will investigate and take appropriate legal action, at its sole discretion, against anyone who violates this Agreement, including, without limitation, removing the offending communication or Content from the Service and terminating the Membership of such violators without a refund. Illegal and prohibited Content includes Content that:
i. Is blatantly offensive to the community, such as Content that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual;
ii. Harasses or advocates harassment of another person;
iii. Involves the transmission of junk mail, chain letters, unsolicited mass mailing, or spamming;
iv. Promotes information that you know is false or misleading, or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous;
v. Promotes an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacturer-installed copy-protection devices, or providing pirated music or links to pirated music files;
vi. Contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
vii. Displays pornographic or sexually explicit material of any kind;
viii. Provides material that exploits people under the age of 18 in a sexual or violent manner or solicits personal information from anyone under 18;
ix. Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
x. Solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
xi. Engages in commercial activities and/or sales without our prior written consent, such as contests, sweepstakes, bartering, advertising, and pyramid schemes;
xii. Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognizable offense, prevents investigation of any offense, or is insulting to any other nation;
xiii. Impersonates another person.
9. Prohibited Content and Conduct
xiv. Deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature.
g. You must use the Aabad Rishtey Service in a manner consistent with all applicable local, state, and federal laws, rules, and regulations.
h. You cannot include in your Member profile, visible to other members, any telephone numbers, street addresses, URLs, or email addresses.
10. Copyright Policy
You cannot post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.
If you believe that your work has been copied and posted on the Aabad Rishtey service in a way that constitutes copyright infringement, please provide us with the following information:
a. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
b. A description of the copyrighted work that you claim has been infringed;
c. A description of where the material that you claim is infringing is located on the Site;
d. Your address, telephone number, and email address;
e. A written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
f. A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
Notice of claims of copyright infringement can be sent to us in writing to the contact address provided under the Help/Contact section on the site.
10. Your Interaction with Other Members
You are solely responsible for your advertisements and communications with other Aabad Rishtey Members. Aabad Rishtey reserves the right, but has no obligation, to monitor disputes between you and other Members. Aabad Rishtey also reserves the right to take appropriate action against errant members. However, Aabad Rishtey is not obliged to share such action with other members, including complainants. Aabad Rishtey expressly disclaims any responsibility or liability for any transactions or interactions between the members inter-se.
11. Contributions Towards Social Initiatives
a. Aabad Rishtey, through its platform, may facilitate contributions towards social initiatives.
b. Aabad Rishtey is only facilitating the transactions for collecting contributions towards such initiatives.
c. Aabad Rishtey shall not be responsible for the end use of the amounts being contributed.
d. In the event of any refund of subscription fees by Aabad Rishtey, any amount contributed towards social initiatives shall not be liable for a refund.
12. Privacy
Use of the Aabad Rishtey Site and/or the Aabad Rishtey Service is governed by our Privacy Policy, which outlines how we protect your privacy and manage your personal information.
13. Disclaimers
a. Aabad Rishtey is not responsible for any incorrect or inaccurate content or listing posted on the Site or in connection with the Aabad Rishtey Service, whether caused by Users, Members, or by any of the equipment or programming associated with or utilized in the Service, nor for the conduct of any User and/or Member of the Aabad Rishtey Service, whether online or offline.
13. *Disclaimers (continued)*
b. Aabad Rishtey assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to, or alteration of, User and/or Member communications, or any communications by Aabad Rishtey to its Members.
c. Aabad Rishtey is not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to Users and/or Members or to any other person’s computer related to or resulting from the Aabad Rishtey Service.
d. Under no circumstances will Aabad Rishtey be responsible for any loss or damage resulting from anyone’s use of the Site or the Service and/or any Content posted on the Aabad Rishtey Site or transmitted to Aabad Rishtey Members. You should not provide your financial information (such as credit card or bank account information), or wire or otherwise send money, to other Members.
e. The exchange of matchmaking profiles through or by Aabad Rishtey is not a matrimonial offer and/or recommendation from/by Aabad Rishtey. Aabad Rishtey shall not be responsible for any loss or damage to any individual arising out of, or subsequent to, any relations (including but not limited to matrimonial relations) established pursuant to the use of Aabad Rishtey Service.
f. The Site and the Service are provided “AS-IS,” and Aabad Rishtey expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Aabad Rishtey cannot guarantee and does not promise any specific results from use of the Site and/or the Aabad Rishtey Service. You understand that Aabad Rishtey makes no guarantees, either express or implied, regarding compatibility with individuals you meet through the Service.
g. Aabad Rishtey expressly disclaims any liability or responsibility whatsoever arising as a result of any Content/listing posted on the Site/made available to Aabad Rishtey by any Members or the users of the Site or any third party.
14. *Limitation on Liability*
a. Aabad Rishtey does not assume any responsibility or liability for any illegal Content posted on the Site by any Members, users, or any third party.
b. All liability, whether civil or criminal, arising out of any Content posted on the Site will be that of the Member/user/third party who has posted such Content. Aabad Rishtey reserves the right to claim damages from such Member/user/third party for any harm suffered as a result of such Content posted on the Site.
c. In no event will Aabad Rishtey be liable to you or any third person for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits arising from your use of the Site or the Aabad Rishtey Service, even if Aabad Rishtey has been advised of the possibility of such damages.
d. Notwithstanding anything to the contrary contained herein, Aabad Rishtey’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Aabad Rishtey for the Service during the term of membership.
15. *Jurisdiction*
a. If there is any dispute about or involving the Site and/or the Service, by using the Site, you unconditionally agree that all such disputes and/or differences will be governed by the laws of India and shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, India only.
16. *Indemnity*
a. You agree to indemnify and hold Aabad Rishtey, its subsidiaries, affiliates, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above and/or any fraudulent act on your part.
17. Other
a. By becoming a Member of the Aabadrishtey.com service, you agree to receive certain specific emails from Aabadrishtey.com and/or its group sites. You can unsubscribe at any time for any reason quickly and easily by clicking on the unsubscribe link enclosed in the email. You can also manage your subscription to these emails using the My Alert Manager option.
b. This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the Aabadrishtey.com service, contains the entire agreement between you and Aabad Rishtey regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
c. By becoming a member of Shaadi.com and/or using the Services of the Site, you unconditionally and irrevocably confirm that you have read and understood the above provisions and agree to abide by them. If you do not agree to any of the above terms and conditions, please refrain from registering on the Site.
d. Aabad Rishtey is a trademark of People Interactive (Hassam Matrimony PrivateLimited.)
e. This Agreement is an electronic document in terms of the Information Technology Act, 2000, and the rules thereunder pertaining to electronic records as applicable and amended. This electronic record is generated by a computer system and does not require any physical or digital signatures.
